Terms of service.

1. About these terms

These terms apply when you use this website or engage Web Cardiff, run by Tom, for web design, hosting or care plan services. "I" and "me" means Web Cardiff. "You" means the client or visitor. By engaging my services, you agree to these terms.

2. Services

I provide:

• website design and development (custom-built Next.js sites and WordPress sites)
• website hosting
• care plans (maintenance and support)
• related web services

The scope of each project is set out in a quote before any work starts.

3. Prices and payment

3.1 Quotes

Quotes are valid for 30 days from the date they're issued, unless the quote says otherwise. They're based on the information you give me, and may change if the scope of the project changes.

3.2 Websites paid for once

A custom-built site is £600 and a WordPress site is £800, each covering the pages a typical small business site needs. Much bigger projects, such as online shops, are quoted separately. You pay half to start and half when you're happy and the site is live. Other arrangements can be agreed in writing.

3.3 Care plans and hosting

Care plans for sites paid for once are Essential (£10 a month), Plus (£20 a month) and Pro (£30 a month). Hosting is included in every care plan. Care plans are billed monthly in advance, with no minimum term. Invoices are due within 14 days unless we agree otherwise.

3.4 Pay monthly

The pay monthly plan is £99 a month, all in. It includes a custom-built website, UK hosting, an SSL certificate, daily backups, security updates and small changes each month. There's nothing to pay upfront. The monthly fee is billed in advance.

The pay monthly plan has a minimum term of 12 months. After that, it continues month to month and you can cancel whenever you like. If you cancel during the first 12 months, the remaining payments for that term are still due.

On the pay monthly plan, the website is provided as an ongoing service rather than a one-off purchase, so its design, code and files stay mine. Any content and images you supply remain yours. If the plan ends, the website goes offline at the end of your last paid month, unless you choose to buy it outright at a price we agree in writing.

3.5 VAT

I'm not registered for VAT, so no VAT is added to my prices. If that ever changes, I'll tell you before it affects anything you pay.

4. What I need from you

To keep your project on track, you agree to:

• send the content, images and other materials the project needs in good time
• give feedback and approvals within the timescales we agree
• make sure the content you provide is accurate and doesn't infringe anyone else's rights
• give me access to any existing hosting, domain or other accounts the project needs
• pay invoices by their due date

5. Timescales

Most sites are live about two weeks after our first call, and bigger sites take longer. Timescales are estimates and depend on both of us doing our part. Late content, slow feedback or changes to the scope can push the date back.

If a project is paused for more than 30 days because of delays on your side, I may invoice for the work done so far and agree a new date to restart.

6. Revisions and changes

6.1 Design revisions

Each project includes a reasonable number of design revisions, as set out in your quote. Extra rounds beyond that are quoted separately.

6.2 Changes to scope

Changes to the agreed scope, such as extra pages, features or functionality, are quoted separately and may change the timescale and total cost.

7. Ownership

7.1 Your content

You keep ownership of all the content, images, logos and other materials you provide. You confirm you have the right to use them.

7.2 Your website

For sites paid for once, you own the website design and the custom code written for your project once you've paid in full. While I host it, the files stay on my systems; if you'd like a copy, for example to move the site elsewhere, ask me and I'll provide one. For the pay monthly plan, see section 3.4. You don't own:

• third-party software, plugins or themes, which have their own licences
• my general development tools, frameworks or reusable code
• stock images, which stay subject to their licence terms

7.3 My portfolio

I may show finished work in my portfolio and marketing, unless you ask me in writing not to.

8. Hosting

8.1 Acceptable use

Websites I host must not contain:

• illegal content, or content that infringes anyone else's rights
• malware, viruses or malicious code
• content that is defamatory, threatening or discriminatory
• adult content, unless agreed in writing

8.2 Fair use

Hosting is subject to fair use. If a site uses an unusually large amount of server resources, I may ask you to move to a larger hosting arrangement.

8.3 Uptime and backups

Sites are hosted on UK servers, and the hosting provider guarantees 99.9% uptime. I take daily backups of the sites I host, but I recommend you keep your own copies of important content too.

9. Care plans

Each care plan covers the services listed for that plan. Care plans don't include:

• redesigns or new features, unless your plan includes them
• changes beyond your plan's allowance
• fixing problems caused by plugins you've installed yourself, or by weak passwords
• problems caused by other people's interference

Anything extra is quoted separately.

10. Limitation of liability

As far as the law allows:

• my total liability for any claim relating to my services is limited to the amount you paid me for those services in the 12 months before the claim
• I'm not liable for indirect or consequential losses, including lost profits, data or business opportunities
• I'm not liable for downtime or data loss caused by things outside my control

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

11. What I promise

I promise that:

• my services will be provided with reasonable care and skill
• your website will work substantially as shown to you at handover

I can't promise that a website will never go down or never have an error, or that it will achieve any particular search ranking, traffic or business result.

12. Ending an agreement

12.1 Website projects

Either of us can end a website project with 7 days' written notice. You'll be invoiced for the work done so far. Once that's paid, you own the finished work you've paid for, as described in section 7.2.

12.2 Care plans

You can cancel a care plan whenever you like. It stops at the end of the month you've already paid for, and payments already made aren't refunded. As hosting is part of the care plan, your website goes offline when it ends, so if you'd like to move it elsewhere, ask me for a copy of its files before then (see section 7.2). For the pay monthly plan, see section 3.4.

12.3 Ending for breach

I may stop providing services straight away if you seriously break these terms, don't pay invoices, or use the service in a way that harms my systems or other clients.

13. Things outside our control

Neither of us is liable for delays or failures caused by things beyond our reasonable control, such as natural disasters, war, pandemics, internet outages or government action.

14. Disputes

If we disagree about something, we'll first try to sort it out by talking it through. If that doesn't work, we'll try mediation before going to court. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

15. Changes to these terms

I may update these terms from time to time. The version that applies is the one on this page when you engage my services, and I'll update the date at the top whenever it changes.

16. General

• Entire agreement: these terms, together with your quote, are the whole agreement between us.
• Severability: if any part of these terms can't be enforced, the rest still applies.
• Waiver: if I don't enforce a term straight away, I can still enforce it later.
• Transfer: you can't transfer this agreement to someone else without my written agreement.
